Instead, we introduce clients to third-party regulated entities that offer such services. These Terms govern the relationship between you (“Client” or “you”) and BankMyCapital.
If you do not agree to these Terms, you must discontinue using our services immediately.
2. Scope of Services
2.1 Consultancy and Introduction Services
•BankMyCapital acts exclusively as an introducer and consultant by connecting clients with third-party financial institutions, Electronic Money Institutions (EMIs), banks, payment processors, and other service providers.
•We do not directly provide banking, payment processing, licensing, or investment services.
•We do not guarantee the acceptance of any client by third-party service providers.
•Any engagement with a third-party entity is subject to their terms and conditions, and we do not control their decisions or policies.
2.2 No Regulatory Oversight
•BankMyCapital is not a financial institution, bank, investment company, or regulated entity under any financial laws.
•While we introduce clients to regulated service providers, we do not guarantee their adherence to any specific regulatory standards.
•Clients remain solely responsible for ensuring that their business complies with the laws and regulations of their respective jurisdictions.
3. Client Responsibilities
3.1 Accuracy of Information
•Clients must provide accurate, complete, and truthful information when engaging with our services.
•BankMyCapital is not responsible for any delays, rejections, or issues arising from inaccurate or misleading information provided by the client.
3.2 Due Diligence & Compliance
•Clients are responsible for complying with all Know Your Customer (KYC) and Anti-Money Laundering (AML) requirements set by third-party providers.
•We do not conduct independent due diligence beyond our initial assessment.
•Third-party providers may request additional documentation, and failure to provide such documents may result in service denial.
3.3 Legal & Tax Responsibilities
•Clients are solely responsible for understanding and complying with all applicable tax, legal, and financial regulations in their respective jurisdictions.
•BankMyCapital does not provide legal, tax, or compliance advisory services.
4. Fees & Payments
4.1 Service Fees
•Our services are provided on a contractual basis, and all fees are pre-agreed before engagement.
•Fees paid to BankMyCapital are non-refundable, except in cases where explicitly agreed upon in writing.
4.2 Third-Party Fees
•Clients may be subject to additional fees charged by third-party service providers. BankMyCapital has no control over such fees.
•Clients are responsible for making all necessary payments directly to the selected service provider.
5. Limitation of Liability
5.1 No Guarantees
•BankMyCapital makes no guarantees or warranties regarding the approval of applications, success of introductions, or outcomes of engagements with third-party providers.
•We are not liable for any financial loss, regulatory issues, or legal consequences arising from the use of services provided by third-party entities.
5.2 No Responsibility for Third-Party Actions
•We do not control, manage, or oversee the operations of any third-party service provider.
•Any agreements entered into between clients and third-party providers are entirely independent of BankMyCapital.
•We are not responsible for any misconduct, fraud, or regulatory breaches committed by third-party entities.
5.3 Website & Information Disclaimer
•The information provided on our website and communications may contain inaccuracies or omissions.
•We do not guarantee that all information is up-to-date or legally accurate.
•Clients should always seek independent professional advice before making financial or business decisions.
6. Termination of Services
6.1 By BankMyCapital
•We reserve the right to terminate or refuse services at any time, for any reason, including but not limited to:
•Suspected fraudulent activity.
•Failure to comply with KYC/AML requirements.
•Misrepresentation of business activities.
•Any conduct that violates these Terms.
6.2 By Client
•Clients may terminate our services with 14 days’ written notice.
•Termination does not entitle the client to a refund unless otherwise stated in the contract.
7. Governing Law & Jurisdiction
•These Terms are governed by the laws of Panama, where our services are considered unregulated and subject to vague regulatory frameworks.
•Any disputes arising under these Terms shall first be subject to mediation before proceeding to formal legal action.
8. Force Majeure
•BankMyCapital is not liable for any failure or delay in providing services due to circumstances beyond our control, including but not limited to natural disasters, regulatory changes, technological failures, or third-party disruptions.
9. Amendments to These Terms
•We reserve the right to update, modify, or amend these Terms at any time without prior notice.
•Clients are advised to review these Terms periodically to stay informed of any changes.
